Terms and Conditions of Use

ברוכים הבאים לאתר של חברת כנף פרנס כץ אדריכלים בע"מ המופעל בכתובת האינטרנט https://www.gcp-arch.co.il/ (להלן: "האתר"). האתר מופעל, הוקם ומנוהל על ידי  הבעלים והמפעילה חברת כנף - פרנס אדריכלים, גבירצמן, כנף, פרנס בע״מ ח.פ. 513490912 (להלן: "הנהלת האתר") ו/או מי מטעמה.

האתר משמש כאתר תדמית ותוכן ועשוי לכלול גם אפשרויות של שירותים מקוונים אחרים, כפי שמפורט באתר ומתעדכן מעת לעת, באופן מקוון, ובתנאים המפורטים באתר ובתקנון זה.

במסמך זה, למונחים הבאים תהיה המשמעות המפורטת לצידם:
•    "האתר": https://www.gcp-arch.co.il/ (כתובת האתר המלאה) המופעל על ידי הנהלת האתר, ומשמש לצורך פרסום, תדמית ושיתוף מידע ופרטים וכן לכל פעולה ו/או מטרה אחרת ו/או שירותים מקוונים כפי שיוחלט על ידי הנהלת האתר מעת לעת.
•    "המשתמש":  כל אדם המבקר באתר, גולש בו, קורא ו/או צופה בתוכן ומשתמש בשירותים המקוונים המוצעים בו – אם וככל ובעתיד יוצעו בו.

1. The provisions of these Terms shall apply equally to persons of all genders, and the use of the masculine form is for convenience only.

2. The provisions of these Terms and Conditions, the terms of use set forth herein, as well as the "Privacy Policy" published on the Website, define the legal relationship between the user of the Website, whether an individual, a corporation or a business, and the Website and its management, the terms of use of the Website and/or the terms governing the ordering of products and/or services from the Website, if any, and constitute the user's agreement to these terms and to any additional terms appearing on the Website.

3. It is hereby clarified and emphasised that the mere use of the Website constitutes confirmation and acceptance of all the terms set out in these Terms and Conditions, including the Privacy Policy. If you do not agree to any of the terms herein, you are requested to cease all use of the Website.

4. The Website management may, at any time and at its sole discretion, update these Terms and Conditions.

5. These terms apply to the use of the Website and the services included therein through any computer or other communication device, such as a mobile phone, tablet, smartwatch and similar devices. They also apply to the use of the Website whether through the Internet or through any other network or means of communication.

6. Nothing in these Terms and Conditions shall derogate from the provisions of the Israeli Consumer Protection Law, 5741-1981 (the "Consumer Protection Law"), and the regulations enacted pursuant thereto, insofar as they apply to the Website (the "Regulations"), except in cases where such provisions may lawfully be varied and such variation has been made through the Website, whether expressly or implicitly.

7. The Website management makes every effort to present the most complete and comprehensive information possible regarding each product and/or service advertised and/or sold on the Website. Notwithstanding the foregoing, it is clarified that inaccuracies, errors and/or omissions may appear on the Website in good faith, without malicious intent and/or any intention to mislead. The Website and its management shall bear no liability whatsoever arising from such inaccuracies and/or errors.

8. Section headings are provided solely for the user's convenience and orientation and shall not be used for the interpretation of these Terms and Conditions.

9. Any clerical or typographical error in the description of any term, product and/or service shall not bind the Website management.

10. The content published on the Website is provided "as is". The Website management shall not be responsible in any manner for the availability of the Website, its content and/or its services on the Internet or through any other broadcasting medium.

11. The Website content is provided solely for your personal and limited use and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, disseminated or otherwise exploited for any other purpose without prior written authorisation. It is hereby emphasised that the Website management reserves all rights in and to the content, including, without limitation, photographs, visualisations, project names, drawings and similar materials.

12. You may access the Website and the content made available to you for personal use, as intended through the normal functionality of the service. Access to videos, if any, through the service for any purpose or in any manner other than streaming is expressly prohibited. When consuming content, the resolution and quality of the content you receive will depend on a number of factors, including the type of device you are using and your available bandwidth, which may vary during viewing. Although we strive to provide a high-quality viewing experience, we do not guarantee any particular resolution or quality of content streamed to you.

13. In order to view and/or stream content available on the Website, you will need to use a personal computer, portable media player or other device that meets the system requirements which we may update from time to time. The device must be capable of communicating with the service. We may modify the requirements applicable to compatible devices from time to time, and in certain cases, even where a device is considered compatible, its compatibility may depend on software or systems supplied by the device manufacturer or other third parties. Consequently, devices that are currently compatible may cease to be compatible in the future.

14. The Website management may, at its sole discretion, modify the appearance of the Website, the content displayed therein or make any other required change, without prior notice. Users agree that they shall have no claim, action or demand against the Website management and/or anyone acting on its behalf in connection with such changes and/or any malfunctions resulting from such changes.

15. No content from the Website may be copied or used, nor may others be permitted to use such content, whether for consideration, without consideration or in any other manner, including on other websites, in electronic publications, printed publications and similar media, for any purpose whatsoever, without the prior written approval of the Website management.

16. Without derogating from the foregoing, you undertake not to engage in any of the following activities:

17. 16.1. Uploading, sending or transmitting any material containing any type of computer virus or other computer code designed to destroy, disrupt or restrict the use of any computers, servers, hardware and/or software used by the owners or operators of the Website.

18. 16.2. Sending spam to the Website's servers or flooding them with any other form of electronic communication.

19. 16.3. Infringing, in any manner whatsoever, any copyright, trademark and/or other right associated with this Website.

20. 16.4. Embedding the Website, or any part thereof, within a frame on another website or incorporating it as part of another website without the prior written consent of the Website management.

21. 16.5. Using the Website for any unlawful and/or harmful purpose.

22. For all purposes, the date and time recorded in the Website management's computer systems shall be deemed the definitive date and time.

23. The Website management shall have the right to take any measures, whether preventive or subsequent, at its sole discretion and in accordance with applicable law, against any user who uses the Website and/or the services and products offered therein, if and to the extent that such services or products are offered, for purposes other than those for which they are intended, as well as in any case where there is concern or suspicion of the commission of an offence and/or a breach of any applicable law. Without derogating from the foregoing, the Website shall have the right to prevent or block access to the Website, either entirely or to part of the Website's services, by any user who fails to comply with these Terms and Conditions.

1. כל זכויות הקניין הרוחני באתר, לרבות שמו, עיצובו, תוכנו, יישומיו, קוד המחשב וכל חומר אחר הכלול בו, שמה של הנהלת האתר, סימניה המסחריים הרשומים והבלתי רשומים, הינם קניינה הבלעדי של הנהלת האתר.

2. הנהלת האתר הינה בעלת זכויות הקניין הרוחני, לרבות זכויות יוצרים ביחס לכל תוכן המפורסם ו/או מעודכן באתר למעט אם צוין אחרת. זכויות היוצרים כוללות, בין היתר, את כל התמונות ו/או השרטוטים ו/או ההדמיות ו/או הטקסטים המופיעים באתר.

3. התכנים, השרטוטים, ההדמיות והתמונות המפורסמים באתר מהווים יצירה מקורית המוגנת על פי חוקי זכויות יוצרים של מדינת ישראל, אמנות בינלאומיות וחוקי זכויות יוצרים של מדינות אחרות.

4. התוכן המצוי באתר מיועד לשימוש פרטי ולא מסחרי בלבד של המשתמש. על המשתמש חל איסור מוחלט לבצע את הפעולות הבאות ללא קבלת הסכמה מראש ובכתב מהנהלת האתר:
   •    להעתיק, להפיץ, לשכפל, לשדר, להעביר, להציג, להציג בפומבי, להעמיד לרשות הציבור, ליצור יצירות נגזרות, להשכיר, לתרגם או למסור לצד שלישי כל חלק מתכני האתר.
   •    להסיר את זכויות היוצרים או את הודעת הזכויות הקנייניות מכל תוכן או סימן.
   •    לעשות כל סילוף, פגימה או שינוי אחר בחומר המוגן, או כל פעולה שיש בה משום הפחתת ערך ביחס לחומר המוגן, העלולה לפגוע בכבודו או בשמו של בעל זכויות היוצרים.

5. אין לקשר לתכנים מהאתר, שאינם דף הבית של האתר (קישור עמוק) ואין להציג או לפרסם תכנים כאמור בכל דרך שהיא, אלא אם הקישור העמוק יהיה לדף האינטרנט באתר במלוא וכפי שהוא, כך שניתן יהיה לצפות ולהשתמש בו באופן הזהה לחלוטין לשימוש ולצפייה בו באתר וזאת תוך קבלת ההסכמה מהנהלת האתר.

6. הנהלת האתר רשאית להורות על ביטול של קישור עמוק גם לאחר מתן הסכמתה וזאת לפי שיקול דעתה הבלעדי ובמקרב זה לא תהיה לך כל טענה ו/או דרישה ו/או תביעה כלפי הנהלת האתר.

1. מובהר בזאת כי הנהלת האתר אינה אחראית לכל פעולה שתינקט ע”י משתמש ו/או לכל פרשנות שתינתן על-ידו לתכנים המפורסמים באתר. כל פעולה של משתתף בהסתמכו על התכנים המפורסמים באתר הינה על דעתו ואחריותו הבלעדית.

2. תכני האתר אינם מתיימרים להוות ייעוץ אדריכלי ו/או ייעוץ בתחומי הנדל"ן ו/או ייעוץ עסקי, שיווקי, כלכלי או אחר.

3. המשתמש מסכים כי הוא בלבד יישא בכל אחריות וסיכון לכל נזק ו/או הפסד ישיר ו/או עקיף שייגרמו לו בגין השימוש באתר, לרבות צד שלישי, או שייגרמו כתוצאה מהסתמכות על התכנים באתר, מהשירותים המוצעים באתר (אם וככל ויוצעו) או שירותים ו/או מוצרים שיש אליהם גישה דרך האתר. הנהלת האתר אינה אחראית לכל הפסד או נזק שייגרם כתוצאה מהשימוש באתר, לרבות נזקים ישירים או עקיפים, או אובדן מידע ורווחים.

4. תכני האתר, ניתנים בגדר המלצה בלבד, והשימוש בהם הוא על אחריות המשתמש. הנהלת האתר אינה אחראית לתוצאות ישירות ו/או עקיפות של השימוש בתכנים אלו, העלולות להיגרם למשתמש/ת או לצדדים שלישיים, והאחריות המלאה והבלעדית לפעולות המשתמש/ת ותוצאותיהן חלה עליו בלבד.

5. בכל מקרה הנהלת האתר לא תישא באחריות לפעילות כלשהי של כל גורם אחר שאינו בשליטתה המלאה.

1. כל המידע, התנאים והכללים ביחס לנושאים סודיות ופרטיות מפורטים בהרחבה בתוכן "מדיניות פרטיות" המפורסם באתר והנך מתבקש לקרוא אותם. מודגש, כי השימוש באתר מהווה הסכמה גם ביחס לתנאי מדיניות הפרטיות המפורסמים בו.

2. מאחר שמדובר בביצוע פעולות בסביבה מקוונת אין באפשרותה של הנהלת האתר להבטיח חסינות מוחלטת מפני חדירות למחשביה או חשיפת המידע האגור בידי מבצעי פעולות בלתי חוקיות. אם יעלה בידי צד שלישי לחדור למידע אשר שמור בידי הנהלת האתר ו/או להשתמש בו לרעה, לא תהיה למשתמש כל טענה, תביעה או דרישה כלפי הנהלת האתר.

3. הנהלת האתר תהא רשאית לעשות שימוש ב–“עוגיות” (“cookies”) על מנת לספק למשתמש שירות מהיר ויעיל ולחסוך מהמזמין הצורך להזין את פרטיו האישיים בכל כניסה לאתר.

4. בקיום מקרים שאינם בשליטתה של הנהלת האתר ו/או הנובעים מכח עליון, הנהלת האתר לא תהא אחראית לכל נזק מכל סוג שהוא, עקיף או ישיר, שייגרם למשתמש ו/או למי מטעם המשתמש אם מידע זה יאבד או אם יעשה בו שימוש לא מורשה.

1. הדין החל על תקנון זה ו/או על כל פעולה ו/או על סכסוך הנובע ממנו, הוא הדין הישראלי בלבד.

2. בכל מקרה של מחלוקת, תהא לבתי המשפט (השלום או המחוזי) תל אביב הסמכות הבלעדית לדון בה.

3. הדין החל על השימוש באתר, על מדיניות הפרטיות ועל תקנון זה, לרבות פרשנותו ואכיפתו של התקנון הוא הדין הישראלי בלבד.

1. שימוש באתר ו/או רכישת מוצר ו/או שירות באמצעותו מהווים את הסכמת המשתמש לכך שבכל מקרה בו יש למשתמש תלונה על השירות ו/או המוצר ו/או נוצרה מחלוקת, אזי המשתמש מתחייב לנסות תחילה לפתור את המחלוקת בדרך לא פורמלית – על ידי פנייה להנהלת האתר.

2. מוסכם כי רישומי האתר ומערכות מפעילי האתר מהווים רשומה מוסדית כהגדרתה בפקודת הראיות [נוסח חדש], תשל"א-1971, ויהוו ראיה מוחלטת לנכונות האמור בהם. מפעילי האתר יהיו רשאים, אך לא מחויבים, לאכוף את הוראות השימוש באתר ולפעול בכל מקרה בו עלה חשש סביר להפרתם מצד משתמש ו/או צד ג' כלשהו.

1. במידה והוראה מהוראות תנאי השימוש, תקבע על ידי בית המשפט כבלתי חוקית ו/או בלתי תקפה, אזי לא יבטל הדבר את יתר הוראות תנאי השימוש ו/או את יתר חלקי אותה הוראה שבוטלה ו/או צומצמה על ידי בית המשפט, אשר לא בוטלו או צומצמו.

2. כל השתהות של הנהלת האתר ו/או מי מטעמם בקיום זכות המגיעה להם ו/או אי עמידה שלהם על זכות המגיעה להם לפי תנאי השימוש או על פי דין, הינה לפנים משורת הדין בלבד ולא תשמש או תיחשב כוויתור של הנהלת האתר על זכות כאמור.

1. הנהלת האתר שומרת לעצמה את הזכות להוסיף, לשנות, לגרוע ולהחליף בכל עת את הוראות תנאי השימוש המפורטות, כולן או חלקן, לפי שיקול דעתה המלא והבלעדי, וללא קבלת הסכמת המשתמשים.

2. נוסחם המחייב של תנאי השימוש והתקנון הנם אלה שיופיעו מעת לעת באתר ויהיו בתוקף.

3. באחריות המשתמש להתעדכן בשינויים שחלו, אם וככל וחלו, בתנאי השימוש.

4. המשך השימוש באתר לאחר ביצוע שינוי כאמור יהווה ראיה לאישור המשתמש בדבר קבלת השינויים ללא כל טענה ו/או תנאי ו/או דרישה.

5. הנהלת האתר תהא רשאית להמחות ו/או להעביר את התחייבויותיה ו/או את זכויותיה על פי תנאים אלה ללא הגבלה, מכל מין וסוג שהוא, וללא מתן הודעה על כך וללא צורך בהסכמת משתמש ו/או כל צד שלישי אחר.

1. נוסח התקנון כפי שהוא מפורסם באתר הינו הנוסח הקובע בכל עת.

2. הנהלת האתר ו/או מי מטעמם עשויים לעדכן תנאי שימוש אלו מעת לעת באמצעות פרסום של גרסה חדשה באתר שלנו. עליכם לבדוק את העמוד הזה מדי פעם על מנת לוודא שאתם מבינים כל שינוי שנעשה בתנאי שימוש אלו.
